Residential Loan In-House Compliance Attorney

SUMMARY: Provide daily compliance oversight, advise on legal aspects of loan modification and loss mitigation processes, and report to Senior Management on risk issues. Supervise the enforcement and defense of lender’s rights on various assets, including obtaining and realizing upon judgments against obligors.

ESSENTIAL DUTIES AND RESPONSIBILITIES: Provide daily compliance oversight regarding the management of large residential sub-prime portfolio. Must be fluent with FCRA, FDCPA, RESPA, ECOA and TILA along with state and federal consumer privacy and protection acts. Must have working familiarity with foreclosure as well as consumer Bankruptcy law and procedures. Supervise certain legal aspects of loss mitigation program including loan modification and forbearance agreements. Supervise certain litigation related to loan portfolio. May involve some travel to attend trials, depositions, mediations as the authorized corporate representative. Provide general legal advice on matters pertaining to various loan and title issues. Review and evaluate credit files and make recommendations for consideration by management in litigation worksheets and/or loan profiles.

QUALIFICATIONS: Admitted lawyer in good standing with a minimum of 7 years experience in Residential Loan Compliance. Some prior jury trial experience is preferred.

EDUCATION and/or EXPERIENCE: Must be a graduate from an ABA accredited law school. Experience representing creditors is required. Must have certification of passing state bar exam.

LANGUAGE SKILLS: Must have strong legal writing and communication skills. Contemporary computer skills are required.

REASONING ABILITY: High level of problem-solving skills to review and evaluate legal and/or business problems, conduct research and recommend most favorable alternatives. Must be able to perform litigation risk analysis.

CERTIFICATES, LICENSES, REGISTRATIONS NEEDED: Must have certification of passing a state bar exam along with certificate of good standing.
